Recently, GSA rolled out Mass Modifications for - E-Verify

We have been asked if GSA Schedule contracts for commercially available professional services are exempt from the e-verify requirements. We believe that, as written, the FAR does not exempt professional services. FAR 22.1803(c) (4) provides that the e-verify clause does not have to be included in contracts for commercial services that meet 3 criteria. Specifically, a solicitation for commercial services is exempt from e-verify if the services are: (i) Part of the purchase of a COTS item (or an item that would be a COTS item, but for minor modifications); (ii) Performed by the COTS provider and (iii) Are normally provided for that COTS item. Professional services generally would not satisfy the criteria set forth above.

On July 6, GSA released two solicitations for multiple award, Indefinite Delivery, Indefinite Quantity (IDIQ) contracts for commercial satellite communications (COMSATCOM) end-to-end solutions.
Solicitation CS2_(QTA)(010)(CTA)(0003) - open to all. The CLOSE DATE IS THURSDAY, AUGUST 12, 2010 BY 4:30 PM EASTERN TIME. The proposed Custom SATCOM Solutions (CS2) contract, valued at $2.6 Billion, will adhere to the Federal Acquisition Regulations (FAR) Part 15 for negotiated award(s).
Solicitation number CS2_(QTA)(010)(CTA)(0010), set aside for small business, is valued at $900 Million.
CS2 is part of the Future COMSATCOM Services Acquisitions program, an agreement between GSA and the Defense Information Systems Agency. The agreement puts GSA in the driver’s seat for purchasing satellite services for all civilian and defense agencies. The GSA project manager of Future COMSATCOM Services Acquisitions, Kevin Gallo, suggested that the sales could exceed $5B over ten years. This effort combines DISA’s INMARSAT Airtime and Equipment contract, Defense Information System Network Satellite Transmission Service-Global pact, and GSA’s SATCOM II program. DSTS-G has a bridge contract that extends to 2013, and the others expire in 2012. Agencies are expected to begin issuing FCSA task orders later this year.
The Coalition for Government Procurement (CGP) is now accepting nominations for the 2010 Excellence in Partnership (EIP) Awards. Nominations will be accepted via online entry form through September 6. The winners will be honored during the EIP dinner at the Hilton McLean Tysons Corner on November 1.
The Secretary of the Treasury has specified a 3.125% interest penalty for agencies that do not pay in accordance with the Prompt Payment Act. This rate is effective from July 1 to December 31, 2010. Agencies that do not pay in accordance with contract terms or within 30 days of receipt of an accepted invoice where payment terms are not in the contract must add interest to their payments whether requested by the contractor or not.

Job Description
This position has overall responsibility for acquisition and management of all GovConnection contracts, including State, Local, Education and Federal Government contracts, subcontracts and contract-specific vendor agreements. Specific duties and objectives include but not limited to:
- Manage the GovConnection contracts department; supervising, training and developing employees in multiple locations.
- Manage the compliance of all contract requirements, including the delivery of products, services and Contracts Data Requirements List (CDRL) items.
- Manage the development, preparation and pricing of proposal responses and contract based task orders, quotes and proposals.
- Negotiate the terms and conditions of all GovConnection customer contracts.
- Manage the relationship with contracting officers and officials. Negotiate favorable pricing of contract modifications and changes. Initiate and respond to requests for contract changes, product substitutions and technical refreshments.
- Minimize contract risk by monitoring the preparation, quality, achievement and timeliness of all contract deliverables. Maintain complete, accurate, up-to-date contract files.
- Enhance contract marketability by coordinating the development and enhancement of contract and/or customer specific websites, catalogs and other tools. Serve as the primary point of contact for contract information for sales, marketing, and vendors.
- Manage the timeliness, quality and accuracy of contract data. Responsible for the maintenance of contract data in the internal sales and support infrastructure.
Required Skills - Bachelor's degree or equivalent experience in a related field is required.
- 7 to 10 years of related and progressive experience in Government contract acquisition and management required.
- Familiarity with the Government procurement process from solicitation through contract closeout.
- Familiar with the Federal Acquisition Regulations
